Here are the full terms and conditions for Express Newspapers competitions. Please read these carefully before entering one of our competitions. By entering a competition published in any of the newspaper and/or online editions of the Daily Express, Sunday Express, Daily Star, Daily Star Sunday and any other newspaper, magazine and online publications produced by Express Newspapers the subsidiary of Northern and Shell plc ("N&S"), from time to time ("publications") the participant in the competition agrees to the terms and conditions set out here. These terms and conditions and any terms and conditions set out in the competition advertisement or promotional material are referred to as the "rules". In these rules, the term "competition(s)" includes games, promotions and the like, "Editor" or "Editors" means the editor(s) from time to time of the online editions of the newspapers and other online publications published by N&S and "participant(s)" means any person(s) taking part in a competition. If a participant is required to provide such evidence and fails to do so, the Editor may, in his or her discretion, decide to disqualify a participant from the competition or withdraw a prize. 8 When requested, the participant must provide full, truthful and accurate information to requests for evidence of eligibility to participate and must not mislead the promoter. If the Editor believes that information being provided does not comply with this provision, the Editor may, in his or her discretion, disqualify a participant from the competition or withdraw any prize. 9 Unless otherwise stated in the competition advertisement or promotional material, only one entry per individual or household is permitted. In the event that an individual or members of a single household wins or win more than one prize in a competition, only the first of these prizes won will be awarded to that individual or household. 10 The determination of the Editor shall be final in relation to the eligibility of any participant. No correspondence will be entered into about a decision regarding eligibility. Receipt of Entries 11 Unless otherwise stated, entries must be received by the promoter no later than the published closing date for the competition. 12 Proof of posting, emailing, sent SMS ("short messaging service")/text message, sent MMS ("multimedia messaging service")/picture message/video message will not be accepted as proof of receipt of entry by the promoter and no responsibility is accepted by the promoter for entries lost, delayed, mislaid or for any technical failure or for any event which may cause entries to the competition to be delayed, deleted, misdirected, disrupted or corrupted. 13 The promoter is not responsible for incomplete, unclear, incomprehensible or distorted entries. Such entries will be void. Method of Participation and Payment to Enter 14 Where a participant uses a pay-to-enter route for a competition each entry must be accompanied by the appropriate entry fee. 15 Premium Rate Telephone Call Where the selected method of entry is by premium rate telephone call: The cost of the telephone call will be set out in the competition advertisement or promotional material. The cost of calling premium rate telephone lines as specified in the competition advertisement or promotional material is based on calls made using a BT landline. The cost of calls made from public pay phones, mobile telephones and other lines may vary and will depend on the network operator used by the participant.
43 Limitation of Liability 44 To the fullest extent permitted by law, the promoter accepts no liability for any loss or damage of any nature whatsoever and howsoever arising out of or in connection with a participantís entry into the competition (including the use of any prize) and the promoterís use of the entry whether due to inaccuracy, error, omission or any other cause and whether on the part of the promoter (or its servants, agents or any other person or entity). 45 If the promoter is liable to a participant for any reason (other than death or personal injury arising from the promoterís negligence), the promoterís liability will be limited to £100. Notwithstanding any other provision of these rules, the promoter does not attempt to exclude or limit its liability for death or personal injury resulting from its negligence in any way. 46 To the fullest extent permissible by law, the promoter does not make any express or implied warranties, representations or endorsements whatsoever with regard to the competition prizes or any information, service or product provided in connection with a competition. Participants from outside the United Kingdom Unless otherwise stated, all competitions in the publications are controlled and operated by the promoter from its offices in the United Kingdom. Players who enter a competition from outside the United Kingdom do so on their own initiative and are responsible for compliance with all applicable local laws. If participation in a competition or the supply or use of a competition prize are contrary to or infringe any applicable law in a participantís jurisdiction(s), the participant is not authorised to enter the competition. General Provisions 47 If any provision or term of these rules shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the rest of the rules and shall be deemed to be deleted from them. 48 Any failure or delay by the promoter in enforcing an obligation or exercising a right, under these rules, does not amount to a waiver of that obligation or right or any other obligation or right. 49 The participant acknowledges that he or she has not agreed to these rules in reliance on any statement or representation, except in so far as the representation has been incorporated into these rules. The participant irrevocably and unconditionally waives any right the participant may have to claim damages and/or to rescind these terms and conditions by reason of any misrepresentation (other than a fraudulent misrepresentation) not contained in these terms and conditions. 50 These rules and all competitions included in the publications are governed by and construed in accordance with the laws of England and Wales and the English Courts will have exclusive jurisdiction to determine any proceedings in connection with this competition.
